Palabras del congresista de la Republica del Perú, Daniel Abugatas:

“El gobierno peruano tiene que poner fin a toda relación con países que no respetan el derecho internacional”.

Usted tiene toda la razón, veamos:

El derecho internacional tiene mucho que decir sobre el último episodio de violencia que se ha desatado entre Israel y Hamas.

El propósito principal de la ley de la guerra:

–       Proteger a los civiles

–       Minimizar el sufrimiento durante la guerra

En cualquier conflicto, todas las partes – los estados, grupos rebeldes, organizaciones terroristas – tienen la obligación de minimizar el daño a los civiles.

Para cada partido, estas obligaciones son de dos tipos principales:

– La protección de los civiles en las zonas en las que están

– La protección de sus propios civiles de las consecuencias de los ataques de la parte enemiga.

Partes atacantes debe:

1) Atacar sólo personal y los bienes del enemigo;

2) Abstenerse de cualquier ataque indiscriminados;

3) Abstenerse de ataques en los que las víctimas civiles esperado será excesiva a la luz del valor militar del objetivo; y

4) Proporcionar advertencias a los civiles de los ataques cuando sea factible.

En su propio territorio, los militares y los grupos armados deben abstenerse de situar objetivos militares en zonas densamente pobladas y tomar otras medidas para mantener a los civiles fuera de peligro.

Específicamente, la ley también tipifica como delito el uso de civiles como escudos humanos.

Militantes de Hamas son combatientes, no civiles, y por lo tanto no tienen derecho a la protección contra los ataques, al igual que los soldados israelíes no están protegidos de los ataques durante los conflictos.

Es la población civil de Gaza e Israel, y cada otra zona de conflicto que la ley busca proteger, a través de una red global de protección y obligaciones.

Hamás ha anunciado que el lanzamiento de cohetes contra Haifa, en Tel Aviv, en Jerusalén y otras ciudades israelíes. No, en bases militares, unidades del ejército, redes de comunicación o cualquier otro objetivo militar, pero en ciudades pobladas por cientos de miles, incluso millones de civiles. El derecho de la guerra requiere que las partes distinguen entre objetivos militares y civiles, y sólo el personal y los objetivos militares de ataque. Los ataques deliberados contra civiles y los ataques indiscriminados ataques – que son incapaces de distinguir entre objetivos legítimos y civiles – están prohibidas y son crímenes de guerra.

Hamas y la Jihad Islámica disparan sus cohetes por cualquier lugar sin tener en cuenta la distinción entre militares y bienes de carácter civil, o con intención directa de dañar a los civiles y la infraestructura civil.

El uso de escudos humanos no es un esfuerzo romántico en defensa del vecindario – es un crimen de guerra.

El uso de los hospitales como depósitos de municiones o lugares para lanzacohetes pone en peligro todos los civiles que necesitan tratamiento médico, porque una vez que el hospital se utiliza para fines militares, pierde su protección contra los ataques.

El uso de viviendas para todo tipo de actividad militar equivale a utilizar a la población civil como escudo y pone en riesgo la vida de todos los civiles en el vecindario.

Esta conducta demuestra que Hamás no sólo ve cada ciudad y cada civil en Israel como un objetivo – que es totalmente ilegal -, sino que también considera a cada civil en Gaza como un peón prescindible en una guerra de propaganda, una trágica e igualmente ilegal enfoque.

Hamas warns airlines: Don’t fly into Ben-Gurion Airport, we’re targeting it

Shortly after rocket alert sirens were sounded on Friday morning across central Israel, including at the Ben-Gurion International Airport, Hamas’ armed wing has warned airlines that it intends to target the airport with its rockets from Gaza and has told them not to fly there.

“In the light of Israel’s … attacks on the residents of Gaza Strip … The armed wing of Hamas movement has decided to respond to the Israeli aggression and we warn you against carrying out flights to Ben Gurion airport, which will be one of our targets today because it also hosts a military air base,” a statement from the group said.

The militant group said it had issued the warning to the airlines so that they could avoid injury to their passengers.

Earlier, Hamas said that the rocket barrage at central Israel was their first deliberate attempt to hit Ben-Gurion Airport. The organization said that four M-75 rockets were fired at the airport.

But projectiles launched by Gaza militants are largely inaccurate and there have been no reports of any landing in or close to the airport, located in an area covered by the Iron Dome system.

A spokesman for Israel’s airport authority said that a siren had sounded at Ben-Gurion and that all activity had stopped for about 10 minutes, but that the siren was part of a general alert in the Tel Aviv area and not a direct threat to the airport.

Rockets intercepted over Tel Aviv

Three rockets fired from the Gaza Strip towards central Israel were intercepted by the Iron Dome missile defense system over the Tel Aviv area on Friday morning.

Prior to the rocket fire, the rocket alert siren was sounded at around 10:45am in Tel Aviv, Givatayaim, Ra’anana, Herzliya, Bat Yam, Rehovot and other cities in the area.

A synagogue in Tel Aviv, that was closed for renovations, was hit by shrapnel of one of the rockets intercepted by the Iron Dome. No one was inside the synagogue when the shrapnel fell.

The synagogue’s manager, Michael Biton, said that renovations had just finished. “There was a cleaner here this morning right when it happened. She started cleaning, heard the siren and left (to take cover). Right when she left, the rocket (shrapnel) fell and fortunately she was saved.”

At noon time, a house in the Eshkol Regional Council suffered a direct hit from a mortar. The house’s residents were inside the safe room and were unharmed.

Rockets that were later fired towards Ashkelon and its surrounding areas were intercepted by the Iron Dome.

A short while before the rockets fired at Tel Aviv, a rocket fired from the Gaza Strip hit one of the houses in the Sdot Negev Regional Council. Damage was caused to the house and to vehicles nearby, but no one was hurt. Another rocket was found on the grass in the community.

The severely wounded person, a man in his 50s, was unable to flee his car when the rocket hit the gas station. Cars around him caught fire, and rescue units had to pull him out of his car, before it too caught fire. He was suffering burns and wounds to his hand and was taken to the Kaplan Medical Center in Rehovot.

Prior to the rocket hit in Ashdod, rocket alert sirens were sounded in Nes Tziona, Rehovot, Gan Yavne, Netivot, Kiryat Malachi, and the Sha’ar HaNegev and Hof Ashkelon regional councils.

 Overnight, Code Red rocket alert sirens were sounded in southern cities and communities, including the Hof Ashkelon Regional Council, Sderot, Sha’ar HaNegev, Ofakim, Merhavim Regional Council, Netivot, Eshkol Regional Council, Ashdod and Ashkelon.

Rocket alert sirens were also sounded in central Israel – in Nes Tziona, Rehovot, Gan Yavne and Rishon LeZion.
